Terms & Conditions

When reading through the Terms and Conditions, the Privacy Statement and Disclaimer as well as any and all of the agreements, the following terminology is applicable:

1. Client will apply to you, the person who is using this website and thereby accepting the Terms and Conditions set by the Company.
2. The Company, ourselves, our, we and us will apply to Luxury Sleep Center
3. Parties, Party and Us, will apply to both the client and ourselves (Luxury Sleep Center ) or it can apply individually to the client or individually to Luxury Sleep Center.
4. Terms will apply to the offer, acceptance and/or consideration of payment that is needed for us to give assistance to a client in an appropriate manner such as a formal meeting or for the purpose of meeting a client’s needs as set in Luxury Sleep Center stated services and products as it relates to South African law.

The terminology written above when used as the plural, singular or capitulation variation of the words, will be seen as interchangeable and as such it will be seen as the same thus meaning that the Terms and Conditions apply and that the laws surrounding the terms and conditions also apply.

 

General Policy

 

When buying a product from Luxury Sleep Center, please ensure that the product you are purchasing is 100% correct. Many of our pictures have other separately listed products, which aren’t always included in the selected product price. We receive imagery from the suppliers and don't have a hand in the visual designs, which means more often than not, there are accessories, which are not part of the purchase.You may have noticed when searching for a mattress only, in most of the images, the mattress is displayed on the matching base. This is in fact purely to give you, our client, a visual sense of how your mattress would look on a base and does not include the base, when selecting the purchase of a mattress only. It is important to read the description which accompanies the images, to ensure whether you are purchasing the full bed set or just the mattress. The same applies to the images of the bunk beds, which are mostly portrayed with mattresses, but the price is for the bunk bed only. The mattress you can select separately, according to your specific requirements.We always try our utmost to portray correct and current features, descriptions, prices, information, data, benefits and imagery on our website. However, in the unlikely event that you place an order for a product or service, for which any of the information has changed or not yet been updated on our website, we will contact you and advise you of the relevant changes. It will then be your prerogative whether you would then like to proceed with your order. Should it be related to the pricing of the product that you have ordered and as a result of human error, we will advise you accordingly and if the price should be higher than listed, you would be liable to pay the correct price of the product. Refunds Policy (Unused Products)

Should you not be 100% satisfied with any product purchased at Luxury Sleep Center we will refund you in full. Refunds will only be considered under the following conditions and such requests will be handled in the following way:1. The product to be returned must be returned in their original packaging and they must be unused.
2. The product must be in their original condition.
3. Any custom made products cannot be returned.
4. Products with a custom design, fabric or colour choice cannot be returned.
5. Transportation costs of returned products, when they need to be collected by Luxury Sleep Center , will be covered by the client and such costs will be covered by part of the refund.
6. Any transportation costs that are more than the amount the client originally paid for will also be deducted from the refund.7.All above refers to base and mattresses only.8.No refunds on furniture and lounge suites.

Communication

 

Different email addresses have been created for different purposes, i.e. different services have different email addresses in order to get your queries to the right person. Force Majeure

 

In the event that a situation arises that is out of the hands of the parties involved, such as an act of God, war, political insurgence, rioting, terrorism, natural disasters, civil unrest or any other such event, which causes the agreement to be terminated neither party to the contract will be held liable for the termination of the deal. The causes of the termination will need to have been reasonably unforeseen in order for force majeure to be applicable. Either of the party who experiences an unforeseen situation under force majeure will need to inform the other party and must strive to continue forward with the Terms and Conditions as set out in the agreement.

 

Promotions & Marketing

Luxurysleepcenter reserves the right to cancel, suspend or terminate any of its promotions, without notice at any time, and such cancellation, termination or termination shall be deemed to have taken effect from the date of publication on the Luxury sleep center’s  website https://www.luxurysleepcenter co.za/ No liability shall lie against Luxury sleep centerin favour of any participant or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against Luxury sleep centre and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against Luxury sleep center.

Shipping Limitations

When an order is placed, it will be shipped to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this website.  All purchases from this website are made pursuant to a shipment contract.  As a result, risk of loss and title for items purchased from this website pass to you upon delivery of the items to the carrier.  You are responsible for filing any claims with carriers for damaged and/or lost shipments.
